Per IDEA 2004, in the event that a student is suspended from school, it is crucial that Charlie’s IEP team is contacted as well as the school where he is going to be placed. A manifestation determination is when schools and special education teams determine, “whether student misconduct is a manifestation of a disability,” (Russo & Osborne, 2008, p. 169). Russo and Osborne (2008) explain that, “Students may be suspended for more than ten days, or expelled, if the misconduct was not caused by their disabilities,” (p. 171). Seeing as it was determined that Charlie’s behavior was not a manifestation of his disability in his manifest determination review, Charlie’s disciplinary actions are in fact permissible. Much like Charlie’s removal to an IAES, Charlie is entitled to services during the duration of his disciplinary action.
